EDINBURG — A  state district judge said a 16-year-old male accused of driving a van that rolled over and killed nine illegal immigrants last year will be tried as an adult.

Junior Benjamin Rodriguez is accused of driving a van with 17 undocumented immigrants and speeding off after Border Patrol tried to stop him April 10, 2012. Soon after the van drove off, it crashed on the Expressway 83 frontage road in Palmview, killing nine of the immigrants.

The teen was only 15 at the time of the crash, but 332nd state District Judge Mario Ramirez ruled Thursday that Rodriguez will face nine counts of murder as an adult.

The ruling came after a two-day court hearing at the Hidalgo County Courthouse.
