Child killer Rubio cries; jury deliberating punishment
EDINBURG - John Allen Rubio cried quietly this morning as one of his defense attorneys gave his closing arguments and tried to convince a jury to spare the child killer's life.
The jury has now begun the task of deciding whether John Allen Rubio should be sentenced to death for murdering three small children or spend the rest of his life in prison.
The Cameron County District Attorney's Office is seeking the death penalty against Rubio, 29, of Brownsville, who a jury found guilty Monday of beheading the three children of his common-law wife Angela Camacho in March 2003.
Julissa Quesada, 3, John E. Rubio, 14 months, and Mary Jane Rubio, 2 months old were killed inside the family' Brownsville apartment sometime on March 11, 2003. Rubio is the biological father of the youngest child.
Jurors this week heard testimony from several witnesses including Alan Brantley, a former FBI agent and profiler who testified that Rubio is emotionally disturbed and with certain stressors has a high probability of being dangerous.
Jurors also heard from several Catholics, including priests and nuns, who voiced their opinion against Rubio being sentenced to death.
Although the death penalty is being sought against the Brownsville native, the jury has the option of sentencing Rubio to life in prison.
